Escape to Travel issues these tariff documents in the sole capacity as agent for the airline, Tour Company, Cruise Line or other supplier as indicated in the tariff document, brochure, correspondence or other communication as the agent of the supplier Escape to Travel does not assume the responsibility for the cancellation or substitution of service by the supplier, financial default of the supplier, refunds or unused services to be provided by the supplier, or any obligation, service or monies not the specific responsibility of Escape to Travel.
Refunds, Changes and cancellations…
Escape to Travel has advised me of the supplier’s refund charge and cancellation fees and penalties. I am aware that the airline ticket may be subject to the loss of some or all of the fare, should I elect to change or cancel this reservation.
This agent is registered with the California Seller of Travel Program Office of the Attorney General as Escape to Travel and registration number 2079534-40. California law requires certain sellers of travel to have a trust account. This business has a trust account. We are required to deposit 100% of all customer funds into this trust account. Registration as a seller of travel does not constitute approval by the State of California.
Upon cancellation of the transportation or travel services, where the passenger is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the passenger, all sums paid to the seller of travel for services not provided will be promptly paid to the passenger, unless the passenger advises the seller of travel in writing, after cancellation. This provision does not apply where the seller of travel has remitted the payment to another registered wholesale seller of travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service. In this situation, the seller of travel must provide the passenger with a written statement accompanied by bank records establishing the disbursed to a wholesale seller of travel, proof of current registration of that wholesaler.
This transaction is covered by the California Travel Consumer Restitution Fund (TCRF) if the seller of travel was registered and participating in TCRF at the time of sale and the passenger is located in California at the time of payment. Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than 50% for the transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000.00. A claim must be submitted to the TCRF within six months after the scheduled completion date of travel. A claim must include sufficient documentation to prove your claim and a $35.00 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a TCRF claim. For those who purchase travel from outside of California, this transaction is not covered by the California Travel Consumer Restitution Fund.
Agent does not guarantee, and shall not be responsible for any bookings or reservations made or confirmed by agent to the customer in the event that the original itinerary has been changed pursuant to customer’s request. Carriers, suppliers and this agency reserve the right to add on reasonable “change fees” for any modifications.
If you are required to have a passport for these travel destinations. You may obtain a Passport application from your local US Post Office.
